Cannabidiol and the DEA

Over the past few days we have gotten this question about Cannabidiol in many forms.

Is the DEA Unlawfully trying to outlaw all Natural Cannabinoids?

Answer: Yes, however, in our opinion they DO NOT have the power to do so.LAW ENFORCEMENT INSTITUTION Here’s why…

The Farm Bill and Industrial Hemp

This bill is crucial to Hemp’s continued legality, because it defines agricultural hemp as
“the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.”
this bill was signed by congress and the president. All products at GemCBD are below 0.3% and therefore are legal under the Farm bill of 2014. The DEA ISN’T A LAW MAKING INSTITUTION THEY ARE A LAW ENFORCEMENT INSTITUTION. Furthermore the DEA has been defunded by congress regarding use of budget funds for enforcement of conduct which was explicitly authorized by the Farm Bill…Furthermore…and I quote “None of the funds made available by this Act or any other Act may be used to prohibit the transportation, processing, sale, or use of industrial hemp that is grown or cultivated in accordance with subsection section 7606 of the Agricultural Act of 2014, within or outside the State in which the industrial hemp is grown or cultivated.” Back in 2003-2004 the DEA tried to do the same thing and the Hemp Industry Association came down with a lawsuit in federal court and won. Dr Bronner’s was on the list of defendants you might remember it. Don’t fall for the DEA’s scare tactics. CBD has been around longer than the DEA or Congress, we just didn’t know it.
